General Terms and Conditions of Sale – Chloé Thureau EI


These General Terms and Conditions of Sale govern the contractual relations between:


The organizer of treasure hunts and treasure hunts: Chloé Thureau – Individual Entrepreneur (EI).
The Applicant, any natural or legal person wishing to benefit, on their own behalf or for the benefit of third parties, from the services offered.
The Participant, any natural or legal person participating in the services organized by the Organizer.


The reservation and participation in the services organized by Chloé Thureau EI imply unreserved acceptance of these general terms and conditions of sale. These conditions shall prevail over any other general or particular conditions not expressly approved by Chloé Thureau EI.


Chloé Thureau EI reserves the right to modify its general terms and conditions of sale. In this case, the applicable conditions will be those in force on the date of booking or on the date of signing the quote.


-The Organizer:


Chloé Thureau EI, registered under number 882 271 349 and whose head office is located at 32 rue des tertres, 60270 Gouvieux.


-Principle of the game:


On the day of the service, the Participant must go to the place of departure and at the time indicated on his ticket or on his quote. Delays are not tolerated. At the starting point, teams are formed. The Organizer distributes to the participants the necessary equipment for the smooth running of the game. The start is then given.


During the service, the Participant is required to comply with the safety rules in force, and in particular the Highway Code and any other safety instructions. Your journey is carried out under your full responsibility. Chloé Thureau EI cannot be held responsible in case of an accident occurred during the treasure hunt.


Some parts of the proposed route may occasionally be inaccessible for reasons beyond the control of Chloé Thureau EI (road works, temporary closure of certain monuments, natural causes, etc.). Chloé Thureau EI cannot be held responsible for these changes made to the course.


-Conditions of Participation:


Chloé Thureau EI’s services are open to any natural person over 18 years of age. Regarding minors, the service is open to them under the responsibility of the representative or legal guardian.


-Public session:


A public session is defined as a performance organized on one day, at a time and according to a scenario imposed by the Organizer. A public session brings together several participants in the same event.


– Registration:


The Requestor wishing to register for a public session must do so online on the websites www.secret-de-montmartre.com or www.mysteries-hunt.com or alternatively with the Organizer by email or phone.


The participant has a right to access, rectify and delete data concerning him. This right can be exercised online by sending an email to chloe.thureau@gmail.com


The prices are indicated in euros all taxes included. VAT amounts to 20% of the total price. -The prices are indicated in euros, excluding VAT for team-building.
Chloé Thureau EI reserves the right to modify its prices at any time.


The service is nevertheless billed based on the rate in effect at the time of booking. Chloé Thureau EI does not keep the data related to the bank cards of the Applicant following the payment.


-Compliance:


It is the responsibility of the Applicant and the Participant to ensure that the information on the ticket corresponds to their order. Any claim must be made within 24 hours after receipt of the ticket by email. No claim will be accepted after the service.


Regarding the delivery of the ticket by email, it is up to the Applicant to ensure the proper receipt of said email and to inform Chloé Thureau EI otherwise. The responsibility of Chloé Thureau EI cannot be engaged if the Applicant cannot benefit from their service without Chloé Thureau EI having been previously informed that the Applicant has not received anything.


-Handicap :


The Applicant and the Participant must specify to the Organizer the practical necessities according to the disability within 24 hours after the reservation. In the event that access to the game is not possible due to a lack of infrastructure related to the course, the responsibility of Chloé Thureau EI will not be engaged.


-Cancellation:


In case of cancellation by the Applicant, the Applicant undertakes to notify the Organizer. No refund can be granted if the cancellation request is made within 24 hours before the start of the service or after the service.


In case of cancellation of the service by the Organizer due to a case of force majeure such as war, acts of God, natural disaster, fire, flood, extreme temperatures, strikes without notice or any external event, unpredictable and irresistible within the meaning of Article 1218 of the Civil Code, beyond the control of Chloé Thureau EI and hindering the performance of the service, the public session will be canceled or postponed without the participant being able to argue any prejudice. The Organizer will endeavor to inform the Requester before the departure of the game by email or phone if a valid number has been communicated to him. The Applicant agrees that Chloé Thureau EI may use the contact details entered during the reservation to keep them informed.


– Reimbursement:


Any service interrupted, abridged or not consumed by the Participant due to his/her actions and for whatever reason, will not give rise to any refund. No refund can be made in case of loss of the ticket or non-presentation of the ticket on the day of the service.


Any delay or non-presentation is considered as a withdrawal and does not give rise to any refund.


In case of cancellation more than 24 hours before the start of the service by the Applicant, a refund of the amounts already received will be made.


-Hours:


It is imperative to respect the appointment schedule indicated on the ticket. In case of delay, the Participant may be denied access to the service.


-Intellectual and Commercial Property:


This game is a private property both under intellectual property and commercial property. Any reproduction is prohibited.


-Photographic reportage, film shooting or report:


The Participant is personally responsible for obtaining all necessary authorizations in connection with a report or filming during the Organizer’s service.
Before filming or reporting, the Participant must first request written authorization from the Organiser to film or take photos at the location of the service. Otherwise, the Organizer will be required to refuse access to the service to the photographer and/or cameraman.


-Dispute – Consumer Mediation:

In the event of a dispute between the Client and the company, they will strive to resolve it amicably (the Client will address a written complaint to the professional or, if applicable, to the professional’s Customer Relations Department). In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the consumer Client within the meaning of Article L.133-4 of the Consumer Code has the possibility to seize free of charge, if a disagreement remains, the competent mediator registered on the list of mediators established by the Commission for the evaluation and control of consumer mediation pursuant to Article L.615-1 of the Consumer Code, namely:
